Terms of Service

1. Acceptance of Terms

By creating an account or using BuzzPoster ("the Service"), you agree to these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

BuzzPoster is a social media and newsletter management platform that connects to AI assistants via the Model Context Protocol (MCP). The Service allows you to:

  • Connect and manage social media accounts (Twitter, Instagram, LinkedIn, Facebook)
  • Create, schedule, and publish social media posts
  • Create and send email newsletters through your email service provider
  • Define brand voice profiles and target audiences
  • Configure brand voice and audience profiles for AI-assisted content creation
  • Upload and manage media files

3. Account Responsibilities

  • You must provide accurate information when creating an account
  • You are responsible for maintaining the security of your API key and credentials
  • You are responsible for all activity that occurs under your account
  • You must notify us immediately of any unauthorized use of your account
  • You must be at least 18 years old to use the Service

4. Acceptable Use

You agree NOT to use BuzzPoster to:

  • Send spam, bulk unsolicited messages, or automated engagement manipulation
  • Publish content that is illegal, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable
  • Impersonate another person or entity
  • Distribute malware, phishing content, or deceptive material
  • Violate the terms of service of any connected social media platform or email service provider
  • Attempt to gain unauthorized access to other users' data or accounts
  • Use automated tools to circumvent rate limits or usage quotas
  • Resell, sublicense, or redistribute the Service without authorization

We reserve the right to suspend or terminate accounts that violate these rules, with or without notice.

5. Content Ownership

  • You retain ownership of all content you create and publish through BuzzPoster
  • You grant us a limited license to store, process, and transmit your content as necessary to provide the Service
  • AI-generated content suggestions are provided as-is; you are responsible for reviewing and approving all content before publication

6. Service Limitations

  • Free plan usage is subject to limits (audiences, posts per month, AI generations per month)
  • We do not guarantee uninterrupted service availability
  • Social media features depend on third-party platform APIs which may change or experience downtime
  • Newsletter features depend on your configured email service provider
  • AI content generation depends on the Anthropic API and is subject to their usage policies

7. Payment and Billing

  • Paid plans are billed through Stripe on a recurring basis
  • You may cancel your subscription at any time through your account settings
  • Refunds are handled on a case-by-case basis
  • We reserve the right to change pricing with 30 days notice to existing customers

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BUZZPOSTER IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE ARE NOT LIABLE FOR:

  • Any indirect, incidental, special, consequential, or punitive damages
  • Loss of profits, data, or business opportunities
  • Content published through the Service (you are responsible for your content)
  • Actions taken by connected social media platforms (account suspensions, content removal, etc.)
  • Email delivery failures by your email service provider

Our total liability for any claim is limited to the amount you paid us in the 12 months preceding the claim.

9. Account Termination

  • You may delete your account at any time through the dashboard settings
  • We may suspend or terminate accounts that violate these terms
  • Upon account deletion, your data will be permanently removed within 30 days
  • We may retain anonymized, aggregated data for analytical purposes

10. Changes to Terms

We may update these terms from time to time. Material changes will be communicated via email to registered users at least 14 days in advance. Continued use of the Service after changes take effect constitutes acceptance of the updated terms.
